Snapnsell Terms and Conditions

Welcome to Snapnsell, an innovative platform that allows users to take photos of their items, uses artificial intelligence (AI) to identify them, and automatically posts them to eBay as new listings. By accessing or using Snapnsell (the "Platform"), you agree to comply with and be bound by these Terms and Conditions ("T&Cs"). If you do not agree to these T&Cs, you should not use the Platform.

1. Acceptance of Terms

By using Snapnsell, you acknowledge that you have read, understood, and agree to be bound by these T&Cs, as well as any other policies or guidelines that may be posted from time to time.

2. Eligibility

You must be at least 18 years old to use Snapnsell. By agreeing to these T&Cs, you represent and warrant that you are of legal age to form a binding contract in your jurisdiction.

• AI Identification: Our platform uses AI technology to identify the items in the photos.
• Automatic eBay Listings: Once identified, the platform automatically posts the item as a new listing on eBay using the identified data.

By using the platform, you consent to the automatic identification and listing of your items on eBay through Snapnsell.

5. Paid Features

While the basic functionalities of Snapnsell are free, certain features (such as posting items to eBay) may incur charges. The specific fees for these services will be clearly disclosed at the time of usage. By utilizing paid features, you agree to pay the associated fees.

6. Transactions and Payments

All payments for paid services must be made through the payment methods supported by Snapnsell. You are responsible for any fees associated with the use of paid services. All charges are non-refundable unless otherwise specified in these T&Cs.

7. Content Ownership

You retain ownership of any content (e.g., photos, descriptions) you upload to Snapnsell. However, by uploading content, you grant Snapnsell a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the Platform's features (including eBay listings).

8. Prohibited Activities

You agree not to:

• Post any unlawful, harmful, defamatory, or otherwise objectionable content.
• Engage in any activity that disrupts or interferes with the operation of the Platform.
• Misuse the Platform to send spam or engage in fraud or deceitful practices.
• Upload content that violates intellectual property rights or eBay’s policies.

9. AI Accuracy

While Snapnsell’s AI technology is designed to accurately identify items, we cannot guarantee 100% accuracy. It is your responsibility to verify the identified items before they are posted to eBay.

10. eBay Listings

When you use Snapnsell to post items to eBay, you are agreeing to eBay’s terms and conditions. You are solely responsible for the accuracy and legality of the listings, and you must ensure that your use of Snapnsell complies with eBay's guidelines and policies.

11. Fees and Charges

Snapnsell charges fees for certain services, including but not limited to automatic eBay listings. The current fee structure will be made available on the Platform. Fees may be updated periodically, and users will be notified of any changes.

By using paid features, you agree to pay the applicable fees. Failure to pay may result in the suspension of your access to paid features.

12. Disclaimer of Warranties

Snapnsell provides the Platform on an "as-is" basis, without any warranties of any kind, either express or implied, including but not limited to the accuracy, completeness, or reliability of the Platform, AI identification, or the eBay listings. We do not guarantee that the Platform will be error-free or uninterrupted.

13. Limitation of Liability

Snapnsell shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including the AI identification or automatic eBay listings. Our liability for any direct damages shall not exceed the amount paid by you for the paid service.

14. Indemnification

You agree to indemnify and hold Snapnsell, its affiliates, officers, and employees harmless from any claims, damages, or losses arising out of your use of the Platform, violation of these T&Cs, or infringement of any third-party rights.

15. Termination

Snapnsell reserves the right to suspend or terminate your account at any time for violating these T&Cs or for any other reason in its sole discretion. Upon termination, you must cease using the Platform and remove any content you have posted.
